1. Introduction and Scope
ADUMetrics provides an online platform that helps homeowners and prospective accessory dwelling unit (“ADU”) buyers visualize potential projects, explore illustrative layouts using a 3D configurator and floor-plan designer, and—if they choose—connect with independent professionals such as contractors, designers, architects, and lenders. This Policy applies to personal information we collect through the Services and in related email and telephone communications.
This Policy does not apply to the privacy practices of any independent professional or other third party. If you choose to be connected with an independent professional, that party’s own privacy policy governs how it uses your information. We encourage you to review the privacy policy of any third party before providing it with personal information.
2. Personal Information We Collect
We collect the categories of personal information described below. The specific information we collect depends on how you interact with the Services. “Personal information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household, consistent with the California Consumer Privacy Act as amended by the California Privacy Rights Act (“CCPA/CPRA”).
| Category (CCPA) | Examples of What We Collect |
|---|---|
| Identifiers | Name, postal address, email address, telephone number(s) including mobile, IP address, device identifiers, and online identifiers. |
| Customer records (Cal. Civ. Code § 1798.80) | Contact details and, if you pursue financing, certain information you choose to provide. We do not collect full Social Security numbers, government ID numbers, or full financial account numbers through the Services. |
| Commercial information | Project preferences, budget range, services requested, and records of inquiries and interactions. |
| Internet/network activity | Browsing and interaction data, pages viewed, design sessions, clickstream, referring/exit pages, and analytics data. |
| Geolocation data | Approximate location derived from IP address, and the property address and lot characteristics you submit. |
| Property and project data | Address and lot characteristics, design choices, dimensions, square footage, materials/finishes selections, and the renderings/floor plans you generate (“Design Outputs”). |
| Audio/electronic information | The content of messages you send us, and recordings or transcripts of calls with us where permitted by law. |
| Inferences | Inferences drawn from the above to understand your preferences and improve the Services. |
3. Sensitive Personal Information
We do not seek to collect “sensitive personal information” as defined by the CCPA/CPRA (such as Social Security, driver’s license, or financial-account numbers, precise geolocation, racial or ethnic origin, health, or contents of private communications) through the Services, and we ask that you not submit it. If an independent lender requires sensitive information to evaluate financing, it will collect that information directly from you under its own privacy policy and applicable law. To the extent we incidentally process any sensitive personal information, we use it only for purposes permitted under Cal. Civ. Code § 1798.121.
4. Sources of Personal Information
- Directly from you — when you use the configurator or floor-plan designer, request a consultation, create an account, contact us, or submit a form.
- Automatically — through cookies, pixels, server logs, and similar technologies when you use the Services (see Section 8).
- From service providers — such as hosting, analytics, and communications vendors that support the Services.
- From publicly available or third-party sources — such as property/parcel data and mapping and zoning data providers.
5. How We Use Personal Information
We use personal information for the following business purposes:
- to provide, operate, maintain, and improve the Services, including the 3D configurator and floor-plan designer;
- to respond to your inquiries and fulfill your requests;
- to connect you with an independent professional when you ask us to, so that professional can respond to a request you initiate (see Section 6);
- to communicate with you by email, phone, and text consistent with your preferences and our Terms of Use (see Section 9);
- to personalize content and develop and improve our products and services (including using de-identified or aggregated data);
- to measure and analyze usage, perform analytics, and conduct research;
- to detect, prevent, and address fraud, abuse, security incidents, and unlawful activity;
- to comply with legal obligations, enforce our Terms of Use, and establish, exercise, or defend legal claims; and
- for any other purpose disclosed to you at the time of collection or to which you consent.
6. How We Share Personal Information
We may share personal information with the following categories of recipients:
- Professionals you ask to connect with — if you choose to request a consultation, design, or financing options, we provide the information needed to respond to your request to the relevant independent professional(s), at your direction, so they can follow up with you.
- Service providers and processors — vendors that perform services on our behalf, such as hosting, data storage, analytics, communications, customer support, and security, who are contractually limited to using the information for our purposes.
- Analytics and advertising providers — to help us understand how the Services are used and to measure and operate our own advertising, as described in Section 8.
- Corporate transactions — to acquirers, investors, or successors in connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets.
- Legal and safety — to comply with law, legal process, or governmental requests, to enforce our agreements, and to protect the rights, property, or safety of ADUMetrics, our users, or others.
- With your direction or consent — to any other party at your direction.
Where we share information with an independent professional at your direction, we do not control how that professional subsequently uses the information; its use is governed by its own privacy policy.
7. We Do Not Sell Your Personal Information
ADUMetrics does not sell your personal information for money, and we are not in the business of selling or renting consumer data. We do not disclose your personal information to third parties for those third parties’ own independent marketing purposes without your consent. When you ask us to connect you with an independent professional, we share your information only to fulfill that request, at your direction.
We use cookies and analytics and advertising technologies to operate the Services and our own advertising, as described in Section 8. You can manage these technologies and exercise your California privacy choices as described in Sections 8 and 11.
8. Cookies, Analytics, and Tracking Technologies
We and our service providers use cookies, web beacons, pixels, local storage, and similar technologies to operate the Services, remember your preferences, measure performance, and measure and operate our advertising. These technologies may collect identifiers, device and browser information, and internet-activity data.
Social Media and Advertising Platforms (including Meta/Facebook)
We use advertising and measurement tools provided by third-party platforms, which may include the Meta Pixel from Meta Platforms, Inc. (Facebook and Instagram) and similar tools from other advertising and analytics providers. When these tools are active, they may use cookies and similar technologies to collect information such as your IP address, browser and device information, the pages you view, and the actions you take on the Services, and they may combine that information with data they collect across other websites and apps. This information is used to measure the performance of our advertising, to show you relevant ads on those platforms, and to build advertising audiences for our own campaigns. Each platform processes the data it receives under its own privacy policy — for example, Meta’s Privacy Policy is available at facebook.com/privacy/policy.
You can control or opt out of this advertising activity by adjusting the ad-preference and off-platform-activity settings in your account on the relevant platform (for Meta, within your Facebook or Instagram settings), by using the industry opt-out tools listed below, by managing cookies in your browser, or by enabling Global Privacy Control. ADUMetrics does not receive payment in exchange for allowing these platforms to collect this information, and we do not sell your personal information (see Section 7).
You can control cookies through your browser settings and can opt out of certain interest-based advertising through industry tools such as the Digital Advertising Alliance (optout.aboutads.info) and the Network Advertising Initiative (optout.networkadvertising.org). We also honor recognized opt-out preference signals such as Global Privacy Control (GPC) where required by law. Disabling cookies may affect the functionality of the Services.
9. Marketing and Communications
With your consent, ADUMetrics may contact you by email, phone call, and text message (SMS/MMS) about your inquiry, your account, and our products and services, as further described in our Terms of Use. Message and data rates may apply and message frequency varies. You can reply HELP for help and STOP to opt out of texts at any time, and you can unsubscribe from marketing emails using the link in any such email. Calls may be monitored or recorded for quality, training, and compliance where permitted by law.
10. Financing Connections
ADUMetrics is not a lender, mortgage broker, or financial institution and does not make credit decisions or perform credit checks. If you ask us to help you explore financing, we can connect you with an independent lender at your request. Any application, credit inquiry, or financial-account information is collected by that lender directly from you, under its own privacy notice and applicable law, including the Gramm-Leach-Bliley Act and the Fair Credit Reporting Act.
11. Your California Privacy Rights (CCPA/CPRA)
If you are a California resident, you have the following rights, subject to certain exceptions:
- Right to know / access — to request the categories and specific pieces of personal information we have collected, the sources, the purposes for collecting it, and the categories of third parties to whom we disclose it.
- Right to delete — to request deletion of personal information we collected from you, subject to legal exceptions.
- Right to correct — to request correction of inaccurate personal information we maintain about you.
- Right to opt out — to direct us not to sell or share your personal information; as noted in Section 7, we do not sell your personal information.
- Right to limit use of sensitive personal information — to the extent we process any sensitive personal information (see Section 3).
- Right to non-discrimination — we will not discriminate against you for exercising any of these rights.
12. How to Exercise Your Rights
To exercise your rights, you (or your authorized agent) may submit a request by emailing privacy@adumetrics.com or by contacting us using the information in Section 21. Please include enough detail for us to locate your information and respond.
Verification. For requests to know, delete, or correct, we will take reasonable steps to verify your identity before responding, which may require you to confirm certain information we already maintain. We will not fulfill a request unless we can verify your identity to the degree of certainty required by law.
Authorized agents. You may use an authorized agent to submit a request on your behalf. We may require the agent to provide proof of authorization and may require you to verify your identity directly with us.
Timing. We will acknowledge requests within ten (10) business days and respond within forty-five (45) calendar days, with one extension where permitted. There is generally no fee, unless your request is excessive, repetitive, or manifestly unfounded.
13. California “Shine the Light”
California Civil Code § 1798.83 permits California residents to request information about our disclosure of certain personal information to third parties for their direct-marketing purposes. As described in Section 7, we do not share personal information with third parties for their own direct marketing. To make a request, contact us at privacy@adumetrics.comwith “Shine the Light Request” in the subject line.
14. Data Retention
We retain personal information for as long as necessary to fulfill the purposes described in this Policy, including to provide the Services, comply with legal obligations, resolve disputes, and enforce our agreements. Retention periods vary based on the type of information and the purpose for which it is processed. When information is no longer needed, we will delete, de-identify, or aggregate it.
15. Data Security
We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, disclosure, alteration, or destruction. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential and for the security of any device you use to access the Services.
16. Children’s Privacy
The Services are intended for adults eighteen (18) years of age or older and are not directed to children. We do not knowingly collect personal information from anyone under sixteen (16) years of age. If you believe a child has provided us with personal information, please contact us and we will take appropriate steps to delete it.
17. Do Not Track Signals
Some browsers offer a “Do Not Track” (DNT) setting. Because there is no common industry standard for interpreting DNT signals, we do not currently respond to them. However, as described in Section 8, we honor recognized opt-out preference signals such as Global Privacy Control (GPC) where required by law.
18. Third-Party Websites
The Services may contain links to third-party websites, products, and services. This Policy does not apply to those third parties, and we are not responsible for their content or privacy practices. We encourage you to review the privacy policies of any third party before providing personal information to it.
19. Users Located Outside California
The Services are intended for users located in the United States, and primarily in the State of California. If you access the Services from outside the United States, you understand that your information will be processed and stored in the United States, where data-protection laws may differ from those in your jurisdiction. By using the Services, you consent to that processing and storage.
20. Changes to This Privacy Policy
We may update this Policy from time to time. When we do, we will revise the “Last Updated” date above and, for material changes, provide additional notice as required by law. Your continued use of the Services after the effective date of any revision constitutes your acceptance of the updated Policy.
